PROBATE, HONESTLY

Probate isn't the problem. Not having a Will is.

Texas probate gets a bad name. With a clear Will, it's usually a straightforward process. Without one, the court has to decide who in your family inherits your estate and in what shares, and everything takes longer. Either way, Jeremy walks your family through every step.

  • WITH A CLEAR WILL

    A straightforward road

    1. 01
The court admits the Will and appoints the executor you chose.
    2. 02
A few required filings, like notices and an inventory.
    3. 03
The executor settles the estate largely without asking the court's permission at every step.

  • WITHOUT A WILL

    A longer, harder road

    1. 01
The court must decide who the heirs are, with family history and witnesses.
    2. 02
An attorney ad litem is appointed to look out for heirs who may be unknown.
    3. 03
Texas law decides who inherits, which is often not who the person would have chosen.

A GOOD PLAN VS. A GREAT PLAN

What if…

A good plan says who receives what. A great plan is ready for the moments no one plans for. Every plan Jeremy prepares, Will or Living Trust, has protective trusts built in.

  • 01

What if a young beneficiary would inherit too soon?

Their share is held and managed in trust until an age you choose, usually 25, instead of arriving all at once.

  • 02

What if a beneficiary is injured or becomes incapacitated?

Their share stays in trust and can support them for life, without a court-appointed guardianship.

  • 03

What if a loved one struggles with an addiction?

Their inheritance stays in trust, and a trustee you chose decides when and how to help.

  • 04

What if a beneficiary is going through a divorce?

Their inheritance stays in trust, kept separate so it isn’t commingled with community property.

  • 05

What if a beneficiary isn’t good with money?

A trustee you chose manages their share and pays for their needs, instead of handing over a lump sum.

  • 06

What if a beneficiary is incarcerated?

Their share waits safely in trust, managed for them, until the time is right.

The real difference isn’t a Will vs. a Trust. It’s a strongly drafted plan vs. a basic one.

Build a great plan

FOR PARENTS OF YOUNG CHILDREN

Who would raise your kids? Who would manage their money?

Two questions every parent should be able to answer. A plan answers both, so a judge doesn't have to.

  • 01

    A guardian you chose

You name the guardian you trust in a Declaration of Guardian, so the people raising your children are the people you chose.

WITHOUT ONEA court decides, and family members can end up disagreeing about who it should be.

  • 02

    A trustee you chose

Protective trusts hold their inheritance, and a trustee you chose manages it for them until they're ready, usually 25.

WITHOUT THEMA court appoints someone to manage it, and your child often receives everything at once at 18.

Kept separate, on purpose. Your Declaration of Guardian is its own short document, separate from your Will, so it's easy to update as your family changes.
